These Terms of Service (“Terms”) govern your access to and use of Berry AI (the “Service”), provided by Akkipet LLC d/b/a Berry AI (“we,” “our,” or “us”). By creating an account, signing in with Google, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• By using the Service, you represent that you have the authority to enter into these Terms.

2. Accounts and Authentication

• To use the Service, you must sign in using Google Authentication.
• You are responsible for maintaining the security of your account and any activity under it.
• You agree not to share your login credentials or use another person’s account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent activity.
• Attempt to gain unauthorized access to the Service, other accounts, or systems.
• Upload or share malicious code, spam, or content that violates applicable laws.
• Interfere with or disrupt the Service or its infrastructure.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property

• All content, features, and functionality of the Service (excluding user-generated content) are owned by us or its licensors.
• You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

5. User Content

• You retain ownership of any data, files, or content you upload to the Service (“User Content”).
• By submitting User Content, you grant us a limited license to store, process, and display it as necessary to provide the Service.
• You are solely responsible for your User Content and must ensure it does not infringe others’ rights or violate laws.

6. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

7. Service Availability

• The Service is provided on an “as is” and “as available” basis.

• We are not liable for any downtime, data loss, or errors caused by third-party services, including Google Cloud or Google Authentication.

• You agree to pay all applicable fees and authorize us to charge your chosen payment method.

9. Disclaimers

• We make no warranties or guarantees regarding the reliability, availability, or accuracy of the Service.
• To the fullest extent permitted by law, we disclaim all warranties, whether express or implied.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim will not exceed the amount you paid us (if any) in the 12 months prior to the claim.

11. Termination

• You may stop using the Service at any time.
• We may suspend or terminate your access if you violate these Terms or if required by law.
• Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.

13. Changes to Terms

We may update these Terms from time to time. Changes will be effective when posted on this page with a revised effective date. Your continued use of the Service constitutes acceptance of the updated Terms.
